今天翻譯一份片場雇傭合同遍尺，屬于商業(yè)和法律文書的范疇截酷。要求譯員采用非常正式的英語來表述信息，所以對多數(shù)翻譯人員來說是個不小的挑戰(zhàn)乾戏。
This morning I continue to translate an employment contract (or Offer Letter), which falls into the category of commercial and legal documents, requring the translator to use the very formal english expressions for the prescribed information, so in my humble opinion, it is a great challenge for most translators.

今天早上2個小時需要翻譯大約2600字的樣子迂苛，所以沒有時間進行點評，今天白天有時間一定補上點評鼓择。
This morning I have to push my way through roughly 2000 Chinese characters for a satifactory version, so time is pressing and I fail to give the comments about my own translation. But when I am free in the day time, i will try to make up for it, so your patience please.

Case 1: 注意細節(jié)表述
在合同履行過程中三幻，乙方獲悉的甲方的信息，或與本片有關的任何信息呐能，未經(jīng)甲方同意念搬，乙方不得對甲乙以外的第三方披露，乙方在任何時候不得發(fā)布對甲方不利的信息；乙方不得私自接受與本片有關的采訪或參加與本片相關的宣傳活動朗徊。

點評：過程中沒有必要千篇一律都用"during the period of",這里用來“In the performance of the contract”首妖，就是一樣的意思，也指“過程中”爷恳。另外悯搔，“nor shall”屬于倒裝句式，上文有否定句義舌仍，后面就可用類似的倒裝，顯得語句多變通危，很有成色铸豁。

Case 2: 陌生或根本不懂的一些概念或詞語，譯員咋辦菊碟？
在本片拍攝期間节芥，未經(jīng)甲方事先書面同意，乙方不得為第三方工作逆害。
During the film shooting period, Party B shall not work for any third party without obtaining the prior written consent or permission from Party A.
即使本片拍攝期已經(jīng)結束头镊，如本片需要加戲、改戲展哭、補錄對白或補拍該片鏡頭而臨時需要乙方提供服務的票腰，甲方需事先通知乙方肌访，經(jīng)商定后乙方按時到場工作，而甲方則根據(jù)乙方的工作時間及工作繁簡與乙方共同協(xié)商勞務報酬坛芽。

Even if the film shooting is completed, but if Party B is temporarily needed to provide more service related to some more shooting, replaying or dialogue replacement or film pickups, Party A shall give a prior written notice to Party B who shall be present at the designated place for work through the consultation, but Party A shall consult with Party B concerning the labor/service remuneration according to the work time and work complexity.

點評：陌生或根本不懂的一些概念或詞語，譯員一定要反復查找翼抠，盡可能找到地道的表達咙轩。如若不然，那就要反復推敲阴颖，自己編譯活喊，比如“加戲、改戲量愧、補錄對白或補拍該片鏡頭”這些都是我不懂的東西钾菊，屬于跨界詞語，找不到侠畔，就編編編结缚。

Case 3:添加輔助用詞，增色譯文
乙方在受聘期間软棺，發(fā)生任何因未經(jīng)劇組授權或超過劇組授權的行為而產(chǎn)生的一切糾紛红竭，其后果由乙方自己承擔。甲方不承擔任何法律責任。
During Party B’s employment period, Party B shall be liable for the consequences arising from all conflicts related to his or her actions unauthorized by the film crew or beyond the authorization of the film crew, but Party A shall not be legally liable for it accordingly.

點評：這里“accordingly”等于according to the actual situation.

Case 4: 翻譯過程茵宪，需要根據(jù)上下文最冰，增補一些必要的詞語
若乙方需第三方同意方可簽署本合同，乙方應在本合同簽署前出示此等第三方（如乙方所屬單位或乙方經(jīng)紀人）同意乙方接受聘用的證明并將此等證明作為本合同之附件稀火。
If Party B has to obtain the consent from a third party prior to the signing thereto, Party B shall show the certificate signed and issued by the third party (such as, Party B’s service unit/entity or Party B’s agent) for accepting the employment prior to the signing thereto which shall be attached thereto as the appendix.

若乙方在簽署本合同時未出具此等證明暖哨，乙方則為向甲方保證乙方可自行決定接受聘用。若因乙方違反此保證而產(chǎn)生糾紛凰狞，概由乙方負責篇裁；若因此而耽誤本片的攝制工作，乙方應賠償甲方的任何經(jīng)濟損失赡若。

點評： 比如：at his or her own discretion（自己謹慎考慮达布，三思而后行）以及at his or her own risk and expense（自擔風險或自掏腰包）

Case 5：
乙方授權他人簽署本合同應向甲方出具授權委托書或委托協(xié)議。授權委托書或委托協(xié)議應明確授權范圍和委托事項逾冬，授權人和委托人對其代理人的代理行為承擔法律責任黍聂。

If Party B authorizes any other person to sign thereto on his or her behalf, the authorized agent or representative shall show the letter of authorization or Authorization Agreement, which shall clearly specify the scope of authorization and the authorized matters, but the authorizer or principal shall be legally liable for the authorized action of the authorized agent or representative.

Case 6：

性別問題無小事，譯員不知身腻，就用"he/she,his or her"

乙方受聘期間产还，在不影響甲方工作的前提下，因故請假嘀趟，需事先提出書面申請脐区，經(jīng)本片制片主任、導演簽字后她按，方可離組坡椒。離組期間的費用由乙方自理，并由甲方在結算時扣除乙方離組期間的相應報酬尤溜。

During Party B’s employment period, If Party B has to ask for a private leave under the premise that he or she won’t affect Party A’s normal work, Party B is required to submit a written application. He or she may leave the film crew after his or her application is signed by the film producer and the director. However, the expenses incurred during his or her private leave shall be borne by Party B at his own expense, and Party A shall deduct the corresponding amount out of the prescribed remuneration for the period when Party B is absent from the film crew.

在本片完成拍攝制作之前倔叼，未經(jīng)甲方同意，乙方退出攝制組宫莱，或接受第三方的約請而中斷或終止履行本合同義務丈攒，將承擔違約責任。Before the film shooting is completed, if Party B withdraws from the camera team without the written consent from Party A or discontinues or terminates the performance of the contract obligations due to the acceptance of any third party’s appointment, Party B shall be liable for breach of contract.

Case 7:
雙方對于本合同中報酬部分的內容屬商業(yè)秘密授霸，雙方應嚴守秘密巡验，不得擅自向第三方傳播，否則將視為對對方利益的侵犯碘耳。
The specific contents related to the remuneration under this contract are the commercial secrets and both parties thereto shall strictly keep it under the confidential condition and shall not disclose it to any third party without permission, or otherwise it shall be deemed as the infringement upon the rights and benefits of the other party.

點評：法律文書翻譯显设，為了避免上下文出現(xiàn)語義重復的現(xiàn)象，常常會采用諸如,"thereof, thereto,whereof"等詞語辛辨，這里的"of"就相當于所有格捕捂，而“to”就相當于“方向或有關”的意思瑟枫，比如：Pl read through the attachment to the contract. You may add any new ideas thereto.

Case 8：

任何一方違反本合同條款的，應在守約方指定的合理期限內（在拍攝期間不超過24小時）糾正其違約行為指攒，否則守約方有權終止本協(xié)議慷妙，而其所有損失由違約方承擔。

Where either party is in breach of any provision herein, the defaulting party shall correct or remedy the breach of contract within the rational time limit (no more than 24 hours during the shooting period) prescribed by the observant party, or otherwise the observant party has the right to terminate thereof and the defaulting party shall be liable for all losses thus caused.
