c. When a nominated bank acting on its nomination, a confirming bank, if any, or the issuing bank decides to refuse to honour or negotiate, it must give a single notice to that effect to the presenter.
c其徙、按照指定行事的指定銀行、保兌行（如有）或開證行決定拒絕承付或議付時喷户，必須一給予交單人一份單獨的拒付通知唾那。

?The notice must state:

b) that the issuing bank is holding the documents until it receives a waiver from the applicant and agrees to accept it, or receives further instructions from the presenter prior to agreeing to accept a waiver; or
b)開證行持有單據(jù)直至收到申請人放棄不符點的通知并同意接受該放棄，或在同意接受對不符點的放棄前河哑，從交單人處收到進一步指示避诽；或
c) that the bank is returning the documents; or
c)銀行退回單據(jù)；或
d) that the bank is acting in accordance with instructions previously received from the presenter.

d. The notice required in sub-article 16 (c) must be given by telecommunication or, if that is not possible, by other expeditious means no later than the close of the fifth banking day following the day of presentation.

正本單據(jù)和副本單據(jù)
a. At least one original of each document stipulated in the credit must be presented.
a.信用證中規(guī)定的各種單據(jù)必須至少提供一份正本。
注：提單衷模、保險單需要提交全套正本鹊汛，其他單據(jù)若無份數(shù)規(guī)定菇爪，提交一份正本。
d. If a credit requires presentation of copies of documents, presentation of either originals or copies is permitted.
d.如果信用證要求提交副本單據(jù)柒昏，則提交正本單據(jù)或副本單據(jù)均可凳宙。
注：如果L/C規(guī)定，正本不能替代副本或者正本另有它用职祷，那么正本不可以替代副本氏涩。
e. If a credit requires presentation of multiple documents by using terms such as "in duplicate", "in two fold" or "in two copies", this will be satisfied by the presentation of at least one original and the remaining number in copies, except when the document itself indicates otherwise.
e.如果信用證使用諸如“一式兩份”、“兩張”有梆、“兩份”等術語要求提交多份單據(jù)是尖，則可以提交至少一份正本，其余份數(shù)以副本來滿足泥耀。但單據(jù)本身另有相反指示者除外饺汹。
a. A commercial?invoice:
a. 商業(yè)發(fā)票：
i. must appear to have been issued by the beneficiary (except as provided in article 38);
i. 必須在表面上看來由受益人出具（第三十八條另有規(guī)定者除外）；
ii. must be made out in the name of the applicant (except as provided in sub-article 38 (g));
ii. 必須做成以申請人為抬頭（第三十八條（g）款另有規(guī)定者除外）
iii. must be made out in the same currency as the credit; and
iii. 必須與信用證相同幣種痰催。
iv. need not be signed.
iv. 無須簽字兜辞。
注：加注證明的文件需簽字，比如有certify夸溶， stating等字樣
b. A nominated bank acting on its nomination, a confirming bank, if any, or the issuing bank may accept a commercial invoice issued for an amount in excess of the amount permitted by the credit, and its decision will be binding upon all parties, provided the bank in question has not honoured or negotiated for an amount in excess of that permitted by the credit.
b. 按照指定行事的被指定銀行逸吵、保兌行（如有）或開證行可以接受金額超過信用證所允許金額的商業(yè)發(fā)票，倘若有關銀行已兌付或已議付的金額沒有超過信用證所允許的金額缝裁，則該銀行的決定對各有關方均具有約束力扫皱。
注：按照此條款，實務操作中捷绑，30%T/T韩脑，70%L/C時，發(fā)票金額寫100%粹污，沒問題段多。
c. The description of the goods, services or performance in a commercial invoice must correspond with that appearing in the credit.
c. 商業(yè)發(fā)票中貨物、服務或履約行為的描述必須與信用證中的描述一致厕怜。
注：不是鏡子反射衩匣，但是信用證45A的內(nèi)容要全部顯示在商業(yè)發(fā)票中。如果添加細節(jié)粥航，沒改變性質，視為相符生百。
a. A bill of lading, however named, must appear to:
a. 無論其稱謂如何递雀，提單必須表面上看來：
i. indicate the name of the carrier and be signed by:
i. 顯示承運人名稱并由下列人員簽署：
?the carrier or a named agent for or on behalf of the carrier, or
承運人或其具名代理，或
?the master or a named agent for or on behalf of the master.
船長或其具名代理蚀浆。
Any signature by the carrier, master or agent must be identified as that of the carrier, master or agent.
承運人缀程、船長或代理的任何簽字必須分別表明其承運人搜吧、船長或代理的身份。
Any signature by an agent must indicate whether the agent has signed for or on behalf of the carrier or for or on behalf of the master.
代理的簽字必須顯示其是否作為承運人或船長的代理簽署提單杨凑。
注：提單必須（1）顯示承運人的名稱（2）并注明簽發(fā)人的身份滤奈。
主單，尤其是大的船公司（比如COSCO, Evergreen）的主單, 上面會顯示carrier的名稱撩满，簽發(fā)人的身份一般是as agent for the carrier.
小單蜒程，容易在此產(chǎn)生不符點！
延伸一下伺帘，對從事國際物流的小伙伴來說昭躺，如果非常熟悉信用證對提單的要求，那么在提單確認環(huán)節(jié)伪嫁，就可以快速地確認一份沒有不符點的提單领炫，靠專業(yè)的服務爭取到更多的客戶；同時提高老客戶的認可度张咳。
iv. be the sole original bill of lading or, if issued inmore than one original, be the full set as indicated on the bill of lading.?
iv. 系僅有的一份正本提單帝洪，或者，如果出具了多份正本脚猾，應是提單中顯示的全套正本份數(shù)碟狞。
案例：信用證中對提單的要求，沒有寫提交的份數(shù)婚陪，受益人提交了一份正本的多式聯(lián)運提單族沃，提單注明簽發(fā)了三份正本。
問：受益人提交一份正本提單泌参，是否構成不符脆淹？
答：是不符點。盡管信用證沒有要求全套正本提單沽一，仍要提交全套正本盖溺。
保險單據(jù)也一樣，所有正本均須提交铣缠。
a. If the expiry date of a credit or the last day for presentation falls on a day when the bank to which presentation is to be made is closed for reasons other than those referred to in article 36, the expiry date or the last day for presentation, as the case may be, will be extended to the first following banking day.
a.如果信用證的截至日或最遲交單日適逢接受交單的銀行非因第三十六條所述原因而歇業(yè)烘嘱，則截止日或最遲交單日，視何者適用蝗蛙，將順延至其重新開業(yè)的第一個銀行工作日蝇庭。
b. If presentation is made on the first following banking day, a nominated bank must provide the issuing bank or confirming bank with a statement on its covering schedule that the presentation was made within the time limits extended in accordance with sub-article 29 (a).
b.如果在順延后的第一個銀行工作日交單，指定銀行必須在其致開證行或保兌行的面涵中聲明交單是在根據(jù)第二十九條a款順延的期限內(nèi)提交的捡硅。
c. The latest date for shipment will not be extended as a result of sub-article 29 (a).
c.最遲發(fā)運日不因第二十九條a款規(guī)定的原因而順延哮内。
案例：某國外開來的信用證規(guī)定：LC效期?Oct./1/2020，最后裝運日期：空白
問：1）信用證截至日期是哪一天壮韭？
2）最遲裝運日期是哪一天北发？
答：1）信用證截至日期順延至下一個工作日纹因，即2020年10月9日
2）最遲裝運日期不順延，Oct./1/2020
案例：
問：FormE,FormF蓋章顯示FormA,是不符點嗎琳拨？
答：是
問：信用證中CFR后面2個不同的港口瞭恰，單據(jù)中能照抄兩個港口嗎？
答：不可以狱庇，按照實際的卸貨港口寫
問：LC要求BL showing the full name and address of agent at the port of discharge,卸貨港是A,此地址寫B(tài) 城市的地址惊畏，是不符點嗎?
答：是，因為讓顯示的是目的港代理的名稱和地址僵井，顯示其他城市是不可以的
