constructive total loss（保險(xiǎn)法）推定全損 ? ?=constructive loss

1）Such serious damage to the insured property that the cost of repairs would exceed the value of the thing repaired.

2) Marine underwriting【海上保險(xiǎn)】. According to the traditional American rule, such serious damage to the insured property that the cost of repair would exceed half of the thing repaired.

指被保險(xiǎn)財(cái)產(chǎn)雖未完全滅失毀損蚕断，但已不能修復(fù)，完全喪失使用價(jià)值报嵌，被保險(xiǎn)人已不能從中獲益，應(yīng)推定財(cái)產(chǎn)全損并獲得全部賠償遭殉。

economic loss ??經(jīng)濟(jì)損失

在產(chǎn)品責(zé)任訴訟中對經(jīng)濟(jì)損失的賠償包括對瑕疵產(chǎn)品的修理或替換所需費(fèi)用廊谓，以及由于價(jià)值不足而產(chǎn)生的商業(yè)損失【commercial loss】和因失去利潤或使用效益而產(chǎn)生的間接損失古沥。

general average loss ??共同海損的損失

Marine underwriting. A loss at sea usu. incurred when cargo is thrown overboard to save the ship; a loss due to the voluntary and intentional sacrifice of parts of a venture (usu. cargo) to save the rest of the venture from imminent peril.

因共同海損措施的采取所造成的特殊犧牲或費(fèi)用。

intangible loss ??無形損失

The damage caused by the disruption of an intangible right or benefit.

一種非經(jīng)濟(jì)上的損失称诗∑笺玻可包括由原告人所蒙受的侮辱、生活享受的喪失及自尊的喪失。由一般損害賠償?shù)呐薪o補(bǔ)償癣诱。例如就平等機(jī)會(huì)而言计维，即使受損害的感受不能以金錢價(jià)值評估，判給亦不應(yīng)屬象征性撕予，否則會(huì)輕視或減少對公共政策的尊重鲫惶。

net operating loss?經(jīng)營凈損失

The ?excess of operating expense over revenues, the amount of which can be deducted from gross income of other deductions do not exceed gross income.

指經(jīng)營費(fèi)用超過收益的余額，如果其他扣減項(xiàng)目的總金額未超過總收入实抡，則該余額可從總收入中扣減欠母。

paper loss ?賬面損失 ? ? =unrealized loss

A loss that id realized only by selling something (such as a security) that has decreased in market value.

已發(fā)生而尚未實(shí)現(xiàn)的損失，如持有的證券價(jià)格下跌吆寨，則會(huì)有賬面損失赏淌，但只有在拋售之后，才會(huì)變?yōu)閷?shí)際損失啄清。

pecuniary loss ??金錢損失

A loss of money or of something having monetary value.

指金錢或其他有價(jià)值財(cái)產(chǎn)的損失六水，也指可期待的金錢或其他有價(jià)值財(cái)產(chǎn)的損失。

salvage loss ??海難救助損失

1） Generally, a loss that presumptively would have been a total loss of certain services had not been rendered.

2) Marine underwriting. The difference between the salvage value, less the salvage charges, and the original value of the insured property.

海上保險(xiǎn)術(shù)語辣卒，指由于救助人的救助行為而避免的被保財(cái)產(chǎn)的損失總額缩擂，亦即被保護(hù)財(cái)產(chǎn)因救助而仍得以保存之部分的財(cái)產(chǎn)價(jià)值。 ?被保險(xiǎn)財(cái)產(chǎn)的保險(xiǎn)價(jià)值減去救助報(bào)酬和費(fèi)用即為救助損失添寺。
